Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.yeahwerun.nz website and/or booking a tour operated by Yeah We Run Ltd (“us”, “we”, or “our”). 

Your access to and use of the services provided are conditional on your acceptance of and compliance with these Terms.  These Terms apply to all visitors, users and others (“participant”) who access or use the website or our tours.

 By accessing or using the services provided you agree to be bound by these Terms.  If you disagree with any part of the terms then you may not access the services.



Reservations and Payment


To make a tour booking with YeahWeRun participants will need to make a tour booking enquiry.  This can be done by emailing alex@yeahwerun.com, by completing our Booking Enquiry Form online at http://www.yeahwerun.nz/book-tour, telephoning +64 (0)21 676965 or using one of our booking agents.

 Where a tour is available YeahWeRun will reserve the space(s) and will email the participant confirmation of this. Please note all tours must be paid fully in advance in order for the tour booking to be confirmed.  It is not possible to pay in cash on the day.

 YeahWeRun will email a booking confirmation to the participant within 24 hours of full payment being received.  The booking confirmation email will confirm the tour (and any additional items) booked, date, meeting time, meeting location, expected end time and location, YeahWeRun guide contact details and what to bring to the tour.  Please refer to our Cancellations and Refunds Terms below should an amendment to a booking be required. 

The prices on our website and promotional leaflets are correct at time of publication, however, we reserve the right to raise or lower our prices at any time.  YeahWeRun reserve the right not to accept or fulfil a booking request and all booking requests are subject to availability. 

When a reservation is made by one person on behalf of another person or other people, the person making the reservation confirms to us that he or she has the authority to make such a booking on behalf of the other person(s).



Tour Itineraries


YeahWeRun reserves the right to vary a route and thus exclude listed sights, areas and topics, in the event of a route being adversely disrupted by external events. 

YeahWeRun may, on very rare occasions, shorten a proposed route and thus exclude listed sights, areas and topics, if a participant or number of participants are deemed inadequately prepared to safely complete the entire route.   

No refunds will be offered for any amended tour itineraries. 



Under 18’s Policy

Due to New Zealand’s liquor licensing laws, minors under 18 years of age are not authorised to participate on any of our tours where alcohol may be consumed. Minors aged 14-17 years old may, on occasion, be authorised to participate in the tour but this must be agreed in writing in advance of the tour by YeahWeRun.  It is at the discretion of YeahWeRun to determine if an under 18 minor is suitable to participate in the tour, and any decision made by YeahWeRun is final.



Cancellations and Refunds


We understand that it is not always possible to make a scheduled booking for a tour.  To cancel or amend a booking please email alex@yeahwerun.com.  Provided that 48 hours’ notice is given before the scheduled start time of a tour YeahWeRun will provide a full refund (minus PayPal fees) or re-book on an alternative date or time dependent on participant preference.  Where a refund is given this will be via the original payment method.  Please note refunds can take up to 14 days to process.  

YeahWeRun are not able to refund any participant cancellations where less than 48 hours’ notice is given before the scheduled start time of a tour.  Where possible we will offer an alternative date or time to reschedule the original tour.  Please note that in order to reschedule a booking with less than 48 hours’ notice before the scheduled start time of a tour, that YeahWeRun will charge an additional 50% of the original tour ticket purchased.

 YeahWeRun are unable to refund participants who do not show for a tour, and as our tours start promptly, we are unable to offer a refund to any participant who arrives late for a tour. 

YeahWeRun reserves the right to cancel a tour for any reason.  In the unlikely event YeahWeRun cancel a scheduled tour, participants will be informed via their contact email address and an attempt will also be made to contact participants via their contact phone number.  In such an occasion a full refund will be given via the original payment method.



Participant Responsibility and Health

YeahWeRun tour guides will abide by our Health & Safety Manual which aims to keep guides and participants as safe as possible.

The tour starting points are in public places and as such YeahWeRun is unable to provide any secure storage areas.  Participants are advised to bring only essential items and are responsible for any items they bring with them onto the tours.   It may be possible to store small items in your guide’s back pack but participants do so at their own risk of loss, theft or damage.  YeahWeRun are not liable for any loss, theft or damage caused to a participant’s belongings before, during or after a tour. 

Participants are also responsible for their own safety throughout the tour and are expected to exercise due care and attention at all times throughout the tour.  Your guide will look to ensure safe routes and road crossings but YeahWeRun is not liable for any injury, accident or even death caused to a participant during a tour.

 Participants are responsible for ensuring they are dressed appropriately for running, including wearing trainers suitable for these activities.  New Zealand weather is very changeable!  Participants are advised to check the weather forecast ahead of the tour commencing as they are responsible for dressing appropriately for the climate.  Participants are also encouraged to ensure they stay hydrated throughout the tour and YeahWeRun recommend they bring water with them. Instructions on what to bring on each tour will be emailed to each participant and YeahWeRun bears no responsibility for lack of preparedness by participants.



Participants acknowledge that taking part in a running tour with YeahWeRun is physically strenuous.  At the start of each tour your guide will ask general questions about your health. If you have a known medical condition, injury or feel unwell it is your responsibility to declare this in full to the guide, where appropriate, to bring a medical certificate authorising participation in the tour.  YeahWeRun reserve the right to refuse to allow a participant to take part in our tours based on the health interview.  YeahWeRun strongly recommend that you consult your doctor and gain medical approval before commencing any running tour with us.  

Participants accept that taking part in running exercises carry the risk of causing injury, both minor and potentially major or even death, and that they participate at their own risk.  YeahWeRun is not liable for any injury, accident or even death caused to a participant before, during or after a tour.


Tour Photographs


YeahWeRun will take photographs of participants and the route on each tour.  These images will be shared digitally with participants after the tour to be viewed or downloaded. Participants understand that on rare occasions it may not be possible to take any photographs, or that the images taken are not of the quality expected.  YeahWeRun are not able to offer refunds for the provision of tour photographs. 

Participants authorise any photographs taken of them during the tour by YeahWeRun to be used wholly or in part in any publication (commercial or otherwise), portfolio, promotional collateral, website, social media or public display.  Participants who do not wish for their photographs to be used for this purpose will need to declare so before the tour begins.  These photographs are copyright to YeahWeRun.  Use of the photographs may be granted to third parties, however the photographs will remain the property of YeahWeRun. 

Participants are invited to bring their own small cameras or use smart phone cameras along the route to capture their own special memories of the tour. 



Participant Behaviour


YeahWeRun reserves the right to refuse a participant to take part in a tour, at the start of, or at any time during the tour, should the participant’s behaviour be deemed to be offensive to other participants.  YeahWeRun also reserves the right to stop a participant joining a tour if we feel their behaviour may put the safety of other participants at risk. 



YeahWeRun request that mobile phones are turned off or placed into airplane mode for safety reasons.  We reserve the right to stop a participant joining a tour, or to continue with a tour, if we feel that their use of a mobile phone is a nuisance to other tour participants or could place them in danger whilst using the device.

YeahWeRun reserves the right to refuse a participant to take part in a tour, at the start of, or at any time during the tour, should it be suspected that the participant is under the influence of drugs or alcohol to the extent that they cannot safely complete the tour.

If a participant is refused permission to take part in a tour as a result of behavioural or drug or alcohol reasons, no refund will be given.

Our website may contain links to third-party web sites or services that are not owned or controlled by YeahWeRun. 

YeahWeRun has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.  You further acknowledge and agree that YeahWeRun shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available through any such web sites or services. 

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit. 



Changes


We reserve the right, at our sole discretion, to modify or replace these Terms at any time.  If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect.  What constitutes a material change will be determined at our sole discretion.
